HOW EMPLOYERS SHOULD CONDUCT A PROPER INTERNAL INVESTIGATION

Employers need to conduct prompt, thorough and equitable internal investigations. Compliance costs are soaring as are penalties for inadequate, biased or non-existent investigations. The manner in which an investigation is conducted has a significant effect on an employer’s exposure and ability to defend itself in a future lawsuit or government investigation. This CLE identifies how employers and their attorneys should investigate claims of misconduct in order to ensure compliance with heightened federal, state and media expectations.

UNIFORM GUARDIANSHIP ACT - ARTICLE 83

The NEW Article 83: The Uniform Adult Guardianship Act & Protective Proceedings Jurisdiction Act  A new Uniform Guardianship Act was signed into law in New York last fall and went into effect in April. The act addressed gaps in the Mental Hygiene Law and Surrogate's Procedure Act related to jurisdiction in multiple states. Because seniors often move or spend different parts of the year in different states and because their family members often live in widespread locations, the importance of this act cannot be overstated. This information-packed program will cover the provisions of the new law and what they mean for the guardianship matters you handle.

CAN YOU TRUST YOUR TRUST

Many taxpayers use trusts in their estate plans to avoid probate. A trust is frequently used as the alter ego of a will. Trusts are worthwhile when done properly, but can be nightmares if improperly administered. As a result of the revamping of many state trust laws - including New York's -trustees often find themselves with more questions than they are prepared for, questions without easily discernible answers.

The purpose of this program is to alert practitioners as to the many issues that they must consider from a practical point of view. Ethics issues and potential malpractice situations will be covered as well. The presenter, Seymour Goldberg, has lectured and trained many attorneys and CPAs on the trust accounting income and principal rules under the revised NYS trust accounting laws. His newest book - "Can You Trust Your Trust?" -was published by the American Bar Association in 2014 and is a first of its kind manual, written from a real world standpoint.

Under the Academy’s “buy three, get one free” policy, purchasers may acquire a fourth DVD or audio CD (priced the same or less than the least costly of the other three) at no extra cost.

Discounts: Additional Users & Groups

Law firms or ad hoc groups may fulfill their MCLE requirements at special discounted prices: One member of the group purchases the DVD or audio recording at the listed price; others in the “group” may then utilize the same recording -- either as members of an “assembly”  or sequentially -- at a price that is lower than the original purchase price.  CLE programs of under 3 credits qualify for a $10 per person discount; CLE program of 4 or 5 credits will pay $100 per person and CLE program with 6 or more credits will pay $150 per person.  CLE certificates are mailed to each person.

For additional information on program-specific group pricing, call 631-234-5588.

RECEIVING MCLE CREDIT FOR RECORDED PROGRAMS

DVD or Audio Recording: Users complete a simple evaluation/questionnaire that asks for program-specific comments plus verification codes that are shown or spoken during the program. Upon receipt of a completed evaluation form, the Academy issues a certificate of completed CLE activity.

On-Line: Instructions for receiving credit are provided during the course of the on-line program.

Retention of Certificates: Under the rules of the NYS CLE Board (the regulator of MCLE in New York), lawyers are required to retain all MCLE certificates for at least four (4) years.

Returns and Refunds

If you are dissatisfied with the quality of your DVD or audio recording, return it at any time for a replacement. If the content did not meet your expectations, let us know within 30 days for a refund or substitution of another title.
