HOW EMPLOYERS SHOULD CONDUCT A PROPER INTERNAL INVESTIGATION

Employers need to conduct prompt, thorough and equitable internal investigations. Compliance costs are soaring as are penalties for inadequate, biased or non-existent investigations. The manner in which an investigation is conducted has a significant effect on an employer’s exposure and ability to defend itself in a future lawsuit or government investigation. This CLE identifies how employers and their attorneys should investigate claims of misconduct in order to ensure compliance with heightened federal, state and media expectations.

MOBILE DEVICES IN THE WORKPLACE

The use of employee-owned mobile devices - smartphones, tablets, laptops - for both personal and work purposes has become the norm in the workplace. This increased use of dual-purpose devices creates a number of legal risks for employers, who must ensure the security of business information stored on such devices while not running afoul of employees privacy rights. This program will discuss the latest trends in the use of personal mobile devices in the workplace and address best practices for developing and implementing policies and procedures to address employee dual-use devices and manage the legal risks arising from the use of such devices inside and outside of the workplace.

UNIFORM GUARDIANSHIP ACT - ARTICLE 83

The NEW Article 83: The Uniform Adult Guardianship Act & Protective Proceedings Jurisdiction Act  A new Uniform Guardianship Act was signed into law in New York last fall and went into effect in April. CAN YOU TRUST YOUR TRUST

Many taxpayers use trusts in their estate plans to avoid probate. A trust is frequently used as the alter ego of a will. Trusts are worthwhile when done properly, but can be nightmares if improperly administered. As a result of the revamping of many state trust laws - including New York's -trustees often find themselves with more questions than they are prepared for, questions without easily discernible answers.

The purpose of this program is to alert practitioners as to the many issues that they must consider from a practical point of view. Ethics issues and potential malpractice situations will be covered as well. The presenter, Seymour Goldberg, has lectured and trained many attorneys and CPAs on the trust accounting income and principal rules under the revised NYS trust accounting laws. His newest book - "Can You Trust Your Trust?" -was published by the American Bar Association in 2014 and is a first of its kind manual, written from a real world standpoint.

Audio recordings listed in this catalog were created with MP3 formatting and will play only in computers and audio players that are MP3 compatible. (Older cars, for example, are not.) Discounts: Additional Users & Groups

Law firms or ad hoc groups may fulfill their MCLE requirements at special discounted prices: One member of the group purchases the DVD or audio recording at the listed price; others in the “group” may then utilize the same recording -- either as members of an “assembly”  or sequentially -- at a price that is lower than the original purchase price (usually $50; longer programs cost slightly more).
