The statute of limitations in foreclosure, CPLR ยง213(4) is becoming more relevant as a defense in residential mortgage foreclosures as plaintiffs seek to restart older actions that were dismissed or discontinued. Every civil action has a date by which it must be commenced or else the cause of action is forever time barred. As one would expect, the statute of limitations for any action embodies policy considerations involving the time in which notice must be given to a party against whom a claim has been made. There are essentially eight statutes that govern the statute of limitations. This module examines the case law relevant to the numerous fact patterns concerning the expiration, revival, extension and waiver of the statute of limitations as a defense to foreclosure actions in New York.
